Cravical Terms and Conditions

These terms of use govern your use of our website; by using our website and/or by accepting any price brief by Cravical and any of its sister companies you accept these terms of use in full. Copyrights All services provided by Cravical may be used for lawful purposes only.

Transmission, storage, or presentation of any information, data, or material in violation of any law is prohibited. This includes, but is not limited to; copyright material, or material we deem threatening.

All pages and graphics on this site are the property of Cravical The pages may not be redistributed or reproduced in any way, shape, or form without the written permission of Cravical.

Cravical shall not post any copyright material without permission. It is the responsibility of the Client to provide Cravical with content, text, pictures, images, and any other media that is deemed acceptable.

Any and all original content created by Cravical remains property of Cravical unless specified, and we reserve the right to have reference to Cravical placed on any and all web pages posted for the Client.

Said content may be transferred to the Client only with expressed written consent from Cravical.

The Client retains ownership of any copyrights of any content, text, pictures, images, and any other media the client provides. However, by submitting content, text, pictures, images, and any other media, you grant to Cravical a non-exclusive, worldwide license to link to, reproduce, distribute, adapt, perform, display and sublicense the submitted code/articles or content.

Limitation of Liability

Cravical does not warrant any of its services.
Cravical is not responsible for any grammatical errors found in submitted material by the Client.
Cravical will not be liable for indirect, special or consequential damages, or any loss of revenue or profits, arising in connection with the projects that we develop/developed.
Cravical is providing a service remotely via the internet and multiple public and private facilities, some of which are not within our control.
Cravical does not guarantee the quality or condition of the service.
Cravical reserves the right to delay or stop any project development for any reason without liability.
Cravical is not responsible for any damages incurred from hacking, hackers, illegal activity, nor any changes made to web sites created and maintained by Cravical - without prior permission.
Cravical will not imply to correct any damages or changes made without prior permission, however, we can and will repair any damages incurred to the Clients Web Site(s) using the current pricing policy guidelines.

Project Transfer

A one off fee of GBP 250.00 applies for web site and software transfers for any projects that have been hosted on our servers for less than the minimum contract term of 5 years.
Project Contents All digital and non-digital materials supplied by the client to Cravical for project development must be, either owned by the client or given copyright permission for publication.
Cravical is not responsible for copyright infringements found on these materials.

Cancellation of Project Development

A request to cancel project must be made in writing to Cravical and include the signature of the authoritative client.
Cravical will charge for the number of hours accumulated in project development before the cancellation request is made.
Cravical will notify the client immediately of any changes of project development status, and make appropriate arrangements. If a project in development is cancelled by Cravical the deposit paid will not be refunded.

Pause in Project Development

A request to pause project development must be made in writing to Cravical and include the signature of the authoritative client. The delay will not exceed a period of 7 days. Unless other arrangements are made between both parties, Cravical will assume any delay requested by the client that exceeds the 7 day period a cancellation, and hence will charge for the number of hours accumulated in project development before the request to pause is made.
In the event that a client delays a project for more than 14days in a row, Cravical reserves the right to suspend the project and charge a re-initiation fee of £250.00 to be paid before work is re-started.

URL Servers

Web address hosting and Name servers are not the responsibility of Cravical. Cravical is not a URL provider. Cravical may on occasion assist clients in setting up and pointing their name servers but under no circumstances does Cravical take responsibility for the loss of URLs due to late payment, hacking or any other reason for the loss of URLs.

E-mails and Domains

Cravical is not responsible for setting up clients' e-mails. However, Cravical may on occasion set up clients' email accounts and activate anti spam software. Cravical is not responsible for the detection and/or prevention of spam. Cravical servers are protected by anti-virus software but unless otherwise agreed it is not the responsibility of Cravical if viruses are detected on websites.
Abuse If at any point Cravical feel that a client or representative of a client is behaving in an unruly or abusive fashion, Cravical reserves the right to suspend the client's account indefinitely. If the situation does not improve Cravical reserves the right to terminate the client's account. If an account is terminated under this clause, Cravical reserves the right to demand any outstanding payments due at the time of termination including any part of the required 24 months services fees or for a period agreed by the client and Cravical.
Any work or personal agreement made between a client and any member of Cravical's staff is by no means underwritten by Cravical nor is Cravical responsible for the undertaking of the work or agreement nor is Cravical responsible for the quality of the work unless this has been specifically stated within the terms of the client's project.

Payment Policy

The Deposit (any amount up to 50% of the project value as agreed) is due on the start of the Design Stage.
The remaining amount of the Project value will be due no more than 7 days upon receipt of the service invoice supplied by Cravical. This amount is held by the client in due of snagging. A one time snagging list is agreed between the client and Cravical at the end of the development period. The points on this list are corrected by Cravical and the client is invoiced for payment of the final amount.
A service contract is agreed between the client and Cravical at the outset of the project's development stage. This contract commences on the first day after the project is complete before the snagging period commences and will continue for no less than 24 months unless otherwise agreed to by Cravical This service contract is payable at the beginning of every month.
All payments are to be made to the bank account specified on the invoice sent by Cravical. Any costs incurred in making any payment to the account specified are the responsibility of the client and by no means may the client defer these costs onto Cravical.
Non-usage of a Service is not deemed as proof of cancellation of service. You are responsible for full payment on all accounts whether or not the account is utilized.
If you are responsible for withholding information for completion, the web service commissioned is then deemed payable in full after 7 days from the completion date.
If we are forced to hand your account over to a debt collection agency for collection you will be liable for any collection costs incurred.
Cravical reserves the right to charge a %10 late fee for every 7 days the balance is past due. Cravical reserves the right to suspend any and all services it may be providing and any and all current work being conducted due to failure of Client to remit payment. Balances that are 30 days past due are subject to removal from the servers including deletion of files. All services are non-refundable and Cravical reserves the right to demand any outstanding payments due at the time of removal including any part of of the required 24 months services fees or for a period agreed by the client and Cravical.
Cravical Reserves the right to charge a fee of £250.00 for the reconnection of any suspended services.
Default and Remedies The Client will be in default if there is any one or more of the following actions:

• Failure to pay any amount when due.
• Client fails to comply with any provision of this Agreement.
• Any representation made by Client in this Agreement is or becomes untrue.

If subscriber is in default in any way, Cravical may immediately take any one or more of the following actions:

• Declare all unpaid amounts due and payable.
• Terminate any Agreement with respect to all or any part of the Services.
• Take any other lawful action Cravical may deem appropriate to obtain damages for subscriber's breach.

Please note that there is no guarantee that any email sent to Cravical will be received by Cravical, or that the contents of the email will remain confidential during internet transmission. Cravical reserves the right to change these terms and conditions at any time. Please check this page regularly to ensure you are familiar with the current version. These terms and conditions are deemed legally binding upon Cravical' receipt of deposit from the client.
